DEFINITIONS OF TERMS & CONDITIONS ARE EMAILED TO YOU BEFORE ANY BOOKING IS MADE

 

‘The Travelling Dogs’ or ‘We’ means Gavin Chilvers of 34 Selkirk Way, Chirton Grange, North Shields, Tyne and Wear, NE29 8DD. ‘Customer’, ‘You’ and ‘Hirer’ means the person or persons nominated as the hirer on the Rental Agreement and any person whose credit card is presented in payment of the customer’s charges. ‘Hire Period’ means the hire period referred to on the Rental Agreement or any agreed variation thereof and any additional period during which the Vehicle is in the customer’s possession or control. ‘Vehicle’ means the Vehicle described on the Rental Agreement and includes tyres, tools, accessories, the living equipment and any other special equipment, documents relating to the Vehicle and any replacement Vehicle which may be provided at the discretion of The Travelling Dogs. HIRE RATES QUOTED INCLUDE Mileage allowance of 1000 miles per week (or pro rata per day if longer shorter duration booked) UK Standard Vehicle Insurance UK Standard Equipment and breakdown cover Your Vehicle has comprehensive insurance on the UK mainland for the named driver(s) on the hire agreement, for the Hire Period. Please note that this does not cover your personal property and you are advised to arrange holiday insurance separately. Your hire rate covers one named driver. You may add up to 2 additional drivers for an additional charge (please contact us for a quote). You may NOT take the Vehicle to Ireland or Europe. In the case of a breakdown or accident, a 24 hour phone number is provided on the window screen. In the event of an emergency, please contact The Travelling Dogs as soon as possible. DELIVERY AND RETURN OF THE VEHICLE Collection is 4pm on the day of hire. Please allow one hour for hand over, completion of the paperwork and demonstration of the Vehicle operation. Return time is 11am. We insist on you being punctual, as we want to make sure the Vehicle is fully prepared and serviced for the next customer to enjoy their holiday. On collection of the Vehicle both parties will examine the Vehicle and any existing damage marked on the diagram on the front sheet as evidence of the condition of the Vehicle on collection. Late returns of the Vehicle will be charged at £30 per hour and invalidate your insurance. You will return the Vehicle in a clean condition and in sound working order (this includes the interior, all cooking utensils, chairs, tables and all camping equipment cleaned and in working order) in accordance with the Departure Checklist and with a full fuel tank and full LPG gas. You will return the Vehicle in a clean condition with a full fuel tank, on the return date in the Rental Agreement and at 11am unless agreed otherwise. You acknowledge that The Travelling Dogs will not refund to me any monies, nor have any obligation to provide a replacement Vehicle, if the Vehicle is returned or you cease to have the use of the Vehicle prior to the return date for any reason e.g. accident, weather or theft. RENTAL AND OTHER CHARGES Bookings can be made via e-mail, phone, or via the online contact form. The vehicle cannot be collected or returned on Bank Holidays or Sundays so please take this into consideration when deciding on the days/length of your Hire Period as these days will be charged for. The minimum hire period is 7 days, shorter lengths of hire/weekend hires may be possible out of peak season, please check with The Travelling Dogs or their Special Offer page on their website. You agree to pay The Travelling Dogs: • All rental charges. On booking, a non-refundable booking deposit of £300 per week or part thereof is required. Confirmation of your booking will then be issued by post or email. • The full balance of the rental six weeks before collection date. An invoice will be issued with a due date that payment must be made. If the full balance is not paid by the date shown (ie. six weeks before collection date) The Travelling Dogs have the right to terminate this Agreement, rehire the Vehicle to someone else and retain/recoup the cancellation fee in accordance with this Agreement. • The refundable security/insurance excess deposit. • The nominated cleaning fee of £60 if the Vehicle is not returned with the interior in a clean condition. • The nominated additional fee of £50 if the toilet waste tank is not emptied and cleaned prior to the return of the Vehicle. • An additional charge of £50 per hour for any late return. • The cancellation fee in the event of cancellation of this agreement prior to acceptance of delivery of the Vehicle: o More than 30 days – the deposit of the hire price o 7-29 days – 50% of the hire price o 0-6 days/no show – full hire price • The nominated fee of £30 plus the actual cost of fuel required to fill the diesel and LPG tank if the Vehicle is returned with less than a full tank of fuel or gas. • The cost of any damage to the Vehicle, internal equipment, hired equipment, or the property of any third party, subject to the Insurance cover if applicable. • All parking fines, other fines, duties of penalties, and/or accidents including third party property damage not reported on return of the Vehicle (deposit will be held for 14 days in case of delayed mail notifying us of fines/penalties). • Any other fees or charges payable by me pursuant to this Agreement. This includes any costs incurred by The Travelling Dogs as a result of any breach by me of the terms of this Agreement. • The cost to recover a Vehicle which has become bogged down. PAYMENT OF CHARGES JOINT AND SEVERAL LIABILITY All charges and expenses payable by me under this Agreement are due on demand by The Travelling Dogs. When the customer comprises of more than one person, ie each additional driver, each person is liable jointly and severally for all obligations of the customer pursuant to this Agreement. The Travelling Dogs reserve the right to cancel a booking if payment is not received six weeks prior to departure. For late bookings, less than six weeks before departure, the full rental price is payable with your booking. Your Vehicle will not be released without payment in full. Cheques will not be acceptable for late bookings, less than two weeks prior to departure. You understand that no refunds can be given for an early return of the Vehicle. You understand the need to take out adequate travel and holiday insurance and will do so. CREDIT CARD PAYMENT The Travelling Dogs will accept payment by credit card subject to a 2.5% additional surcharge if paying by direct bank transfer there is no surcharge. When payment is paid by credit card, you agree that The Travelling Dogs is irrevocably authorised to recover from my credit card issuer all amounts due by me pursuant to this Agreement, including but not limited to, any amounts due in respect of damage to the Vehicle or to the property of a third party and all other additional charges as they are incurred (including all parking and traffic infringement penalties, road toll fines, city congestion charges, and associated administration costs). You will not dispute my liability to The Travelling Dogs for any amount due under this agreement and you shall indemnify and keep indemnified The Travelling Dogs against any loss incurred (including legal costs) by reason of notifying your credit card issuer of such a dispute. PAYPAL CARD PAYMENT The Travelling Dogs will accept payment by PayPal subject to a 2.5% additional surcharge, if paying by direct bank transfer there is no surcharge. MY WARRANTIES You warrant that all information and documentation supplied by you to The Travelling Dogs in connection with this agreement is true. You are required to submit all personal details as required on the booking form. The Hirer and main driver at the commencement of hire must produce two forms of personal identification such as a valid passport or driving licence AND two confirmation of address in the form of recent utility bill or a bank/building society statement. A driving licence must be produced at the time of Vehicle collection for each person who may drive the Vehicle. In order for us to verify a driver’s convictions and points on their license, it is necessary to check this on the DVLA website (https://www.gov.uk/view-driving-licence) as such we will need each drivers’ National Insurance Number. So to confirm before releasing the vehicle we will need to see; • Valid driving licence for all drivers. • Drivers must have at least 24-months of driving. • Two official documents dated within last 3 months confirming your address as shown on your driving license. Types of documents that can be shown are :- o Utility Bill, ie.gas, electric or water bill o Bank statements o Credit card o Council tax bill o Phone bill • £750 cleared funds in our account before the collection day for insurance excess/damage deposit. This is refundable on the safe return of the vehicle and 14-days after vehicle has been returned (this is to ensure against any fines that may arrive after the vehicle date). • For insurance purposes we need to take a photo of all drivers. If you are visiting from abroad, your licence needs to be in English or an International driving permit needs to be presented with your national licence. You will only be permitted to hire a vehicle from The Travelling Dogs if you live within the European Union, USA, Canada, Australia, New Zealand, Hong Kong (if previously held a UK licence), Southern Ireland, and South Africa. If, on arrival to collect the Vehicle, your licence is unacceptable due to endorsements, defacement or incorrect Vehicle categories, you understand that no monies will be refunded. SECURITY DEPOSIT/INSURANCE EXCESS DEPOSIT You understand that: • The Vehicle has full comprehensive insurance for damage to the Vehicle and the property of a third party. • You will have to pay an excess for any damage including overhead damage. Overhead damage is defined from the ground up to in excess of 6 feet from the ground. • The £750 taken as a damage/insurance excess deposit at the beginning of the rental will be used for any claims. This security deposit can only be paid on a credit or debit card, balance transfer, PayPal or BACS – NO cash payments are accepted. • Collision damage waiver will provide cover for damage to the rented vehicle. It excludes damage to certain commonly damaged areas of a vehicle such as tyres, wheels and windows. CDW cover is widely available online from third parties but is not automatically included in the hire, so it is your responsibility to obtain it, if you wish. We have personally used and would recommend taking out an ‘insurance excess reimbursement protector’ policy, with a third party insurer such as https://www.questor-insurance.co.uk/motor-home-hire-insurance.aspx • The damage/insurance excess deposit is fully refundable within 14 working days of termination of the hire period, providing the Vehicle and contents are returned undamaged and in a clean, as found condition. • Where damage to the Vehicle has been sustained, the full deposit will be retained. • You will not have any insurance cover and you will be responsible for the total cost of any damage, if you breach any of the terms of this Agreement. • You understand that the insurance damage excess charge of £750 is applicable to each claim, ie if you have 2 claims within a hire period the excess that you are liable for will be £750 x 2 = £1500. HIRE DRIVER INSURANCE You understand and agree that this insurance covers the insured Vehicle whilst let out on hire, subject to the following conditions: The Travelling Dogs will verify the identity and permanent address of the hirer and any other permitted driver by means other than solely on the information contained in the Hirer’s or driver’s driving licence. The insured Vehicle shall not be let out on hire to be driven by: • Persons under 25 or over 75 years of age unless otherwise agreed by the Insurer • Persons without a full driving licence valid in the UK for the relevant Vehicle and which has been held for at least 24 months prior to commencement of the hire (please check you can drive a C1 category vehicle on the reverse of your Photo Card Licence before booking) • Persons who have been convicted of any offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended or penalty points applied. Parking and not more than two speeding offences in the past 3 years may be ignored. More than 6 points may be subject to an insurance surcharge. • Persons who have any mental or physical defect or infirmity or who suffer from fits, diabetes or any heart complaint. • Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of their claims experience and/or have had their insurance or cover cancelled by any Motor Insurer in the past. • Persons who, whilst driving, have been involved in more than one accident in the past 3 years. • The insured Vehicle shall be driven only by the Hirer or other permitted driver who has signed a Hirer’s Proposal Form immediately prior to any hiring. • The Insurer’s form of proposal shall be completed and signed by each hirer or other permitted driver in all respects. • You agree to be bound by the terms and conditions of the insurance, which I have had the opportunity to see and read. • The insured Vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire or reward or any other form of profit or remuneration. • Once again you understand that the insurance damage excess charge of £750 is applicable to each claim. • Please note that if a driver has more than six points for driving convictions on their licence (or is expecting to receive a conviction which will take them over six points) or has more than one fault claim in the previous three years this must be declared to us before booking (and before the hire period, if it changes). We will refer the circumstances to our insurers and will advise whether the hire may proceed either with a surcharge or at all. If you fail to disclose such matters prior to booking, no refund will be given. ANIMALS Dogs are only allowed in the Motorhome subject to the hire agreement. All dogs must be house trained and the number and type of dogs must not exceed what was agreed with The Travelling Dogs at the time of booking, this is usually 3 small terrier sized dogs, 2 medium sized dogs and 1 large dog. You MUST NOT leave any dog unaccompanied in the Motorhome at any time and MUST NOT allow any dog on the beds. Blankets and Throws are provided, you will ensure that at all times the seating areas are covered and protected should a dog use these to lie on/sit on. PLEASE NOTE: The insurance only covers the vehicle hire and you are liable for all damage caused by any dog belonging to anyone who is part of or who is visiting the Hirer’s motorhome. The Travelling Dogs strongly advise that have your own Dog Insurance in place to cover damage to third property/belongings. You understand a charge will be made for any additional cleaning required as a result of any dog(s) staying at the Motorhome during the Hire Period and owners not ensuring bedding/seating/habitation areas are kept clean and covered as specified. When in transit all dogs must be safely secured in the travelling/sleeping kennel at the rear of the motorhome. Small dogs can be belted into the seating area using the supplied harness seatbelt attachment only if a member of the party is seated next to the dog(s) to prevent any damage to table/chairs/seating whilst on the move etc. (i.e. a bored dog may want to start chewing the table edge). Large dogs must not be allowed up on any seating area. The Travelling Dogs cannot be held responsible for any accident, injury or death to any dog(s) travelling in the Motorhome or using any of the supplied dog toys, bowls, treats, harnesses, seatbelt, tethers. SMOKING It is illegal to smoke in any hire vehicle you will not permit smoking in the Vehicle at any time whatsoever which you accept is out of consideration to subsequent hirers who may be non-smokers. Any infringement of this condition will incur an extra cleaning charge of £80. PASSENGERS The Travelling Dogs authorises the use of the Vehicle up to the stated maximum number of 6 passengers. Each person is required to use the safety restraints provided at all times whilst the Vehicle is in motion. Please note though this vehicle has 6 travelling seats there are only 5 berths as the lower rear bunk berth has been adapted for use for the dog kennel area. MAINTENANCE You shall take all reasonable steps to properly maintain the Vehicle, including oil, water, battery and tyre pressure checks. You are required to keep the Vehicle under my control throughout the hire period and you undertake to lock the Vehicle at all times when it is left unattended. You acknowledge that The Travelling Dogs will reimburse you for the expenditure up to £150 reasonably incurred in rectifying any mechanical failure to the drive train and engine of the Vehicle, provided that: • you produce relevant receipts; and • you have received the prior consent of The Travelling Dogs; and • The damage is not due to my fault or my breach of this Agreement. You will be liable for any costs associated with repairing damaged, kerbed, punctured tyres. You are liable for the cost of any wheel/alloy damage, tyre damage or punctures. In the event that a tyre is returned damaged, at the end of your hire, it will be at our discretion whether to repair or replace it. If you have a puncture during your hire you may use the breakdown service to replace the tyre. You will arrange for the puncture to be repaired, or the tyre replaced, as soon as possible after the incident. You will be liable for any costs associated with repairing damaged windscreen, windows, window latches, and window pistons and agree to not let children operate these. You will be liable for any costs associated with repairing damaged blinds and/or fly screens and agree not to let children operate these. You will be liable for any costs associated with the incorrect use of fuel, running out of fuel or loss of keys. All our Vehicles are diesel powered. You will also be liable for the daily charge whilst the vehicle is off the road whilst being repair for incorrect fuel use. RESPONSIBILITY WHEN AN ACCIDENT OCCURS In the event of any accident, loss or damage arising out of the use of the Vehicle, you will: • As a priority deal with any emergencies first, your safety and the safety of your travellers is the priority. • Obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station • Notify The Travelling Dogs by telephone within 2 hours of the happening of the event • If possible photograph damage to all Vehicles involved and registration numbers. Take note of road conditions, weather, light, surface, position of vehicles etc. • Complete an accident report form as supplied • Not make any admission of liability to other parties, settlement offer of other like offer. • Complete an accident form at the termination of hire • Assist The Travelling Dogs in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence. You acknowledge that the excess or other amount due in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period. You understand that The Travelling Dogs accepts no liability for replacement Vehicle cost, travel or accommodation costs or any other consequential loss claims arising from Vehicle breakdown, accident or any other such related causes. The Travelling Dogs cannot accept liability for any cost arising from any accident, theft or vandalism IN THE EVENT OF A BREAKDOWN You are authorised to approve repairs up to £150. • Any repairs in excess of £150 must first be repaird by The Travelling Dogs, prior to the work being undertaken. • In all cases receipts must be submitted in support of any claim. • The Travelling Dogs will not be liable for the cost of any repairs, or other costs incurred, resulting from reckless or imprudent use of the Vehicle. • You will notify The Travelling Dogs by telephone of the breakdown within 24 hours in order to give them the opportunity to rectify the problem during the rental. • Where repairs cannot be made locally or within a reasonable time, the Vehicle must be returned to such location as is required by The Travelling Dogs relay using the cover provided by The Travelling Dogs. • If you arrange for the Vehicle to be recovered to any other location, you will be responsible for the costs of then delivering the Vehicle back to the location required by The Travelling Dogs. • The Travelling Dogs will only be liable to refund the appropriate proportion of your hire fee and will not be liable for any other costs incurred. • Please note where the vehicle fuel, oil or water has become contaminated through use of incorrect fluids (i.e. wrong fuel) you will be liable for any cost associated with repair and daily hire charges to cover repair time of the vehicle whilst off-hire. Once again the hire vehicle is DIESEL. CHANGE OF VEHICLE No other vehicle will be available. STORAGE OF YOUR VECHICLE DURING HIRE PERIOD Any vehicle(s)/contents will be left at the owner’s risk. We expect all vehicles left with us to have current vehicle insurance. RELEASE AND INDEMNITY OF THE TRAVELLING DOGS Subject to its obligation to deliver the Vehicle, you release The Travelling Dogs from any liability to you (regardless of who is a fault) for any loss or damage incurred by you by reason of this Agreement, including but not limited to: • Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for your purpose • Any loss or damage to any property left in or on the Vehicle or any The Travelling Dogs premises or recovered or handled by The Travelling Dogs. You accept that, in certain unforeseen circumstances, The Travelling Dogs may be unable to fulfil the booking due to the selected Vehicle being unavailable/off the road. In these unfortunate instances, you understand that The Travelling Dogs will refund any payments made to date in full. Consequently, I accept that The Travelling Dogs cannot be held responsible for any additional costs incurred in making alternative holiday arrangements, campsite booking fees etc. You shall purchase your own holiday insurance separately to cover such an eventuality. Subject to any insurance arrangements agreed with The Travelling Dogs, you hereby indemnify and shall keep indemnified The Travelling Dogs, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of your use and/or possession of the Vehicle. TITLE TO VEHICLE You acknowledge that The Travelling Dogs retains title to the Vehicle and that you possess the goods as a mere bailee only. You do not have any right to pledge The Travelling Dogs credit in connection with the Vehicle and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle. PROPER LAW This agreement shall be governed by the law of England in which this agreement was signed. ENTIRE AGREEMENT The Travelling Dogs reserves the right to add or amend any terms and conditions without prior notice. The Travelling Dogs reserve the right to adjust hire rates at any time. Quotes will be valid for one week unless a holding deposit is paid. The price will then be fixed at the agreed rate as described on your confirmation of booking and invoice. The Travelling Dogs reserves the right to refuse to hire to any person without stating a reason. If the Hirer is in breach of any of the above terms and conditions, the Hirer shall, upon the demand of The Travelling Dogs, return the Vehicle and its contents immediately. The Hirer will pay The Travelling Dogs, on demand, any loss that The Travelling Dogs may suffer as a consequence of the breach. JURISDICTION Each party agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of in connection with this agreement or its subject matter or formation (including non-controlled disputes or claims).
